Not sure about what can you do by yourself � in this situation would contact some immigration attorney.
More than likely you need to file Motion to reopen (and gain some time)� otherwise you would end up in a one way street �-however not sure about who will need to file (you or your father)? Also not sure about what would be the basis for filing such a case .
Deportation � Since (I assume) you are in the US legally since 98 even if they start the deportation process probably you can file for some relief (I guess if you are here for 7 or 10 years -legally! -then in a case like that there could be some way to avoid deportation, but this would not be automatic).
I would consult with a immigration lawyer....

Agree on the eye, it's important to see that, and have a little catchlight for making the animal look alive. Only problem with the first shot is the branch behind the head. It's blurred a bit which helps though. The background is difficult to control - you take what you get many times with animals and birds.

Why are you going to other forums for advice. Those other forums are after making money from traffic and ads. They want you to suffer as long as possible so that they make money. I recently applied for a PAN Card. Got a DD through my parents in India and sent the form. Today they sent a mail with following --
1) We are yet to receive payment for application.- Kindly e-mail Cheque /DD no. and date on which amount has been debited from your account
2) Photograph provided is not proper for scanning.
Have any one faced similar problem ? A valid DD was included and they say they did not receive the payment ?? Also, the photo was of right size and clear enough so I am not sure what else to do.
Any help will be greatly appreciated

I think
- For Perm and subsequently I-140, you can only specify employers that are directly relevant to the number of years of experience claimed in labor. The details of the petitioning employer are most relevant and all your past employments should add up to the experience required
- However, for I-485, which is your application, you have to specify all the employments that you filed taxes for and from whom you received your paystubs (primary/secondary).

And also, I am looking at a big amount of money that I gotta pay for tuition, does anyone know any tax credits that we can use to reduce the burden ?

Yes, you can do part-time MBA without issues. There are tax breaks both at the federal and possibly the state level (NY has a tax break for students). The tax software will guide you thru it.

Hi All,
I received I485 receipts from my lawyer, they are missing my priority date which is in sept 2002. Not sure why they are missing..
Did any one come across the same situation....

Hello -
I am in sort of big dilemma. My Background:
- Single (not married)
- Currently on H1-B valid until Dec 2011.
- PD July 2007. Company A
- I140 & AOS filed concurrently in Aug 2007. Approved I140 (June 2008) & AOS pending. EAD & AP since Dec 2007.
I am currently working (full-time) for company A who started my GC process since last 3+ yrs. And lately I am realizing that my growth opportunity in terms of salary (more importantly) & career is very limited & been looking out lately. To an extent that I feel so frustrated that it has started to affect my social behavior.
Recently, couple of other employers have shown interest in me which align completely with my future goals. But, the problem is the following:
- they dont do H1-B & willing to hire me on EAD. Hopefully, AC21 should not be a problem as the prospective job will be in the same area.
- I am currently single planning to get married in a year or so. I want my spouse to have an option to be my dependent ie H4.
So, I have following questions to experts here which will help me decide what option to take:
1) Shall I go ahead with new employer & start using EAD ?
2) My GC doesn't seem to get approved for another year or so. Is it worthwhile to keep the option of my spouse being on H4 open & get myself frustrated & spoil my career in current company?
3) Can I move to EAD -> H1-B later? Maybe once I move out of this company A & join company B on EAD either company B or some other company may be ready to file H1-B petition ? This is just to open up the option of my spouse get H4.
Please advise.

In general, if a green card holds stays outside US without any US ties for a long time, s/he technically abandons permanent residence. In practice, doing so may not trigger any activity from USCIS as such and the person may be able to enter US again. However, later on if s/he applies for US citizenship, s/he will likely be in trouble.
Usually people try to come back once every 6 months to maintain permanent residence. However, technically doing so is not sufficient; the key is maintaining ties in US in addition to not remain outside for too long.
You may be able to obtain advance permission from USCIS to remain outside US for a certain period of time without the risk of losing permanent residence. You may want to consult with an immigration attorney to know the options you have for your specific case.

your regular employment letter that you get from HR should work. There is no special format for POE.

My Husband�s priority date is Oct 2003 (EB3). My Employer is willing to start for GC in EB2. Can We use my husband�s EB3 Oct 2003 priority date ?

However, for peace of mind, you can have CBP corect the error. This is easily done by contacting the nearest CBP deferred inspection site. Go to https://help.cbp.gov/app/answers/detail/a_id/818/p/0/c/0"]https://help.cbp.gov/app/answers/detail/a_id/818/p/0/c/0[/URL to find contact information.

You have to go through the same process as a New H1B and it stamped in INDIA again and also get in touch with your new employer he should be able to give you the info you need. Their is no new form to be filled in.
