Hi,
my original labor got approved with a PD in July 2007 with Company A who is my current employer. I also applied for a seperate 140 based on a pre-approved labor in July 2007 with Company B and the PD for that labor is in 2005.
i was told that i can apply for 140/485 with my original labor and once the 140 for the pre-approved labor is approved, i can request for replacing the 140 with the other one with an earlier PD.
could any one repalce the 140 like this? if yes, how long it took for the process. does both 140 needs to be approved to do the interfiling?
what details we need for the 140 that we want to use. just the filing date, A# & approval date or the original or copy of the approval notice.
if Company B or its attoreny is not willing to provide the 140 details or approval notice, is there any way to get those details from INS.
i dont have any details with me except that i know that they applied for 140.

Get it Notarized with photo and send the document.There are standard formats available.
If it is Power of Attorney to deal in property matters on your behalf, then the notarized copy also needs to be stamped by the Indian Consulate in your area.
So there is one more loop involved - to get it endorsed by Indian Consulate, after you have done the notarization. I believe this is something that has become applicable recently as I had to do it last month. A few years ago when I had done the first one, it was just preparing the POA document, and getting it notarized.

Anyone has been in the similar situation. I really don;t want to start my PERM application if owning a company stock will trigger an audit.
If there is even a slight possibility, I would like to give back the stocks to the company (if it is possible)

As you can see in my profile, my I-140 is approved and i'm waiting to file for I-485. I just went through a position change within my company via the company lawyer. The way the lawyer explained to me was that he did file a new H1-B petition for the new job and also i did receive my I797-A action notice from USCIS.
The lawyer had to file a new petition (I-129) based upon my approved I-140 and the most importatn action during this process was to phrase the job description in a way that the new job description was more than 90 percent the same as the I-140.
Moreover, the thing i'm nervous about is that no AC-21 was filed in my case. The lawyer did mention that there is no need to file AC-21 as i have not reached into the I-485 stage and that AC-21 is only applicable after the fact that I-485 has been filed.
Hopefully, my experience clears a few things for your case. You can PM in case you want additional details.
