    hi gurus,

    please advise what are my options. I-140 is pending and i have 9th year H1-B expiring Dec 2009. still working for same company. in case I-140 stays pending up to December 2009. what should i do to stay in status.

    It is mentioned by many that PD should be current at the time of GC approval. Is that right?
    I know people from India who got their GC approved when their PD is not current.
    One can check this easily in looking for I-485 approvals to people from India who submitted their applications concurrently in EB2 category after say april 2004. Disregard the cases which got approved in July 2007. Still there are many cases remaining invalidating the 'rule'!

    The strict rule is that one's PD needs to be current for approval. But if there aren't earlier PDs available for approval ( say stuck in namecheck ) and if USCIS doesn't want to visa numbers for a year to be wasted , then one can get approved even if PD is not current.

    You can take FP test at any location in United States. Just make sure that you go to the nearest location at the time mentioned in the notice. I had an appointment at the Oakland office but I went to the San Jose office and they let me do the FP test there. I had gone to them the previous day to confirm whether I can take FP test at their office and that's when they told me that I can go to any office in US.

    Dont count on it. There is very narrow chance. If you opt CP in 140, NVC will send your papers to consulate abroad, only after your PD become current. Consulate will take their own time to arrange the interview. It will take one month to six months after they recive your file from NVC. During that period the PD has to be always current. Consulate takes out visa numbers for CP, only after a successful interview. If your PD retrogress with in a month (like last year fiasco) consulate will not schudle a interview till it become current again. In that case your file will stuck for ever. Therefore, 485 is the best route. CP is the best route, only if the cutoff dates does not flutuate or retrogress back.

    Whn I entered US after visiting home country Nov 06, they gave me an I 94 till Dec 06 which was the end term of my first H1 B term.
    i got the approval for xtension. In approval notice at the bottom, i see a new I 94 till 2009.
    so now i got 2 I-94's now.
    cud any body tell which is the real one.
    next time whn i go out of this country, which i-94 i shud i hand it over to the officials??
    pls tell ur experiences..thank u

    thanks! but one more thing is that I don't have H-4 approval notice/petition; but I have I-94 valid till 2009. Will this do for H1 approval????

    Looks like your Husband got H1-B extension till 2009; per my knowledge you should have file I-539 along with your husband to get your H4 approval till 2009, if you didn't do it then looks like you need to do right away..or consult your attorney ASAP, I-94 card is doesn't validate your H4 status...

    I am NOT a Lawyer; you many consult lawyer...this type of mistake my friend's did in past...

    Go to nearby embassy and inform about your situation. Make sure to keep all the documents and all also duplicate copy of your visa. Hopefully everything will be fine.

    Please suggest on this I-140 RFE by USCIS:

    Here is what USCIS states:
    Your Petition indicates that you r applying for Professional with Advanced Degree or exceptional Ability . According to ETA 9089 submitted with ur peition the min reeqmnts you are wiling to accept are less than MS degreee. Part H of ETA 9089 indicates employer will accept BS + 72 months of Exp.

    Advanced Deg is defined by US academic of Proff or a Foreign equivalent above BS. In the alternative US BS or a foriegn equiv degree followed by at least five years of progressive experience in the speciality shall be considered equiv to MS degree. ETA 9089 did not allow for any alternative combination of Education and Experience that is acceptable.

    There is no other definition of Advanced Degree. Service therefore finds that the certified ETA 9089 does not support the filing of I-140 in teh requested classification. You are therefor afforded this chance to amend yout I-140.

    My lawyer has send back info that BS + 5 qualifies for EB2 (which USCIS agrees to in their explaination above). However, i believe my Degrees and Exp Letters provided already prove that. I am woried that USCIS may be asking for something else here. Looks like they simply failed to interpret that 72 months = 6 years.

    Hi,
    I am sending my kid ( US born) with my in-laws to india. Any idea what kind of documents they need to carry ( other than passport, PIO, Birth Certificate)
    any body has any expereince?

    Do not forget to give grand parents a letter, duly signed by you and your wife that they are taking a minor US citizen, out of the country with parent's consent. I do not have any particular format to give you. Get it notarized, also mention the dates for which he will be outside the country. I had a tough time with Air France few years ago, I was taking my own baby and my wife was not travelling with me. Air France denied me bording because I did not have a wrttien permission from my wife !! It also differs from airline to airline.
